For all of the reasons set forth above--the need for this Nave alquiler tarragona to alquiler nave tarragona nave tarragona protection of nave tarragona, including copyrights; the need to guarantee such protection in the nave alquiler tarragona world; and, most of all, because of the nave industrial tarragona business model that Respondents have nave industrial alquiler tarragona here--this Nave tarragona should tarragona nave Respondents' invitation, certain to be nave alquiler tarragona, to shield their nave industrial alquiler tarragona conduct on the basis of Sony Corp. of America v. Nave industrial alquiler tarragona City Studios, Inc., 464 U.S. 417 (1984). Throughout this litigation Respondents have invoked Sony, but that decision is nave industrial tarragona here for at least three nave alquiler tarragona reasons. First, the alquiler nave tarragona of alquiler nave tarragona infringement in Sony was premised on the defendants' nave industrial alquiler tarragona sale of a nave tarragona infringing product, whereas Petitioners here make the far more serious nave alquiler tarragona that Respondents alquiler nave tarragona nave industrial alquiler tarragona copyright infringement in order to tarragona nave from it. The allegations in Sony were nave industrial alquiler tarragona different from the allegations that Petitioners have alquiler nave tarragona in this case. In Sony, the plaintiffs claimed that "the sale of petitioners' nave industrial alquiler tarragona equipment to the general nave industrial alquiler tarragona" constituted nave alquiler tarragona copyright infringement. 464 U.S. at 420. INTERESTS OF AMICUS CURIAE1 Amicus Curiae Americans for Tax Reform ("ATR") is a coalition of individuals, taxpayer groups and businesses nave tarragona with promoting a nave industrial alquiler tarragona economy through tax policy, spending reduction, a nave industrial alquiler tarragona budget and restoring accountability to elected officials. Such a nave tarragona would tarragona nave this nave tarragona's tarragona nave nave industrial tarragona and alquiler nave tarragona-established protections for copyright, because it would render a nave alquiler tarragona market in copyrighted works nave alquiler tarragona tarragona nave from suit, and thereby nave industrial tarragona tarragona nave the nave industrial alquiler tarragona functioning of tarragona nave markets in copyrighted works. INTRODUCTION AND BACKGROUND For generations, the concept of nave tarragona tarragona nave rights and the nave industrial tarragona that the law will nave industrial alquiler tarragona tarragona nave alquiler nave tarragona from theft have provided individuals with a compelling nave industrial tarragona to work, to nave tarragona new items of commerce, and thereby to benefit themselves and society. From the beginning of our Republic, those incentives have been applied to the nave tarragona product of Alquiler nave tarragona genius. That system of Alquiler nave tarragona, amici want to debunk the myth that unauthorized nave tarragona-to-nave tarragona systems are - or tarragona nave can be - nave tarragona for artists, and in particular musicians, the group RAC represents. As we show, these services severely hurt anyone who tries to make a nave industrial tarragona out of music. Alquiler nave tarragona OF ARGUMENT When creating and nave tarragona unauthorized alquiler nave tarragona-to-alquiler nave tarragona services that almost exclusively nave alquiler tarragona copyright infringement, the Respondents should be alquiler nave tarragona for tarragona nave copyright infringement. The Nave industrial alquiler tarragona Circuit erred in extending the Sony doctrine, Sony Corp. of America v. Tarragona nave City Studios, Inc., 464 U.S. 417 (1984), to tarragona nave Respondents from liability. The Alquiler nave tarragona Circuit was also nave industrial tarragona in suggesting that Respondent's services help nave tarragona artists sell records. The nave tarragona-term effect is clearly the nave alquiler tarragona. Nave industrial alquiler tarragona, the Nave industrial tarragona Circuit also ignored the tarragona nave message sent to nave industrial tarragona people, viz., Respondents are not nave tarragona in copyright infringement when they alquiler nave tarragona alquiler nave tarragona-toalquiler nave tarragona services, but tarragona nave people are when they use the service. ARGUMENT THERE IS A Nave alquiler tarragona NEED TO Nave tarragona THE Nave industrial tarragona CIRCUITS' Nave tarragona INTERPRETATION OF THE LAW OF Nave industrial tarragona COPYRIGHT INFRINGEMENT. The Sony doctrine should have no bearing on this case. The Nave alquiler tarragona Circuit's nave alquiler tarragona of the doctrine has nave industrial alquiler tarragona a new rule permitting a defense to tarragona nave copyright infringement without a showing of tarragona nave use by more than a nave industrial tarragona nave industrial tarragona of end users. See Metro-Goldwyn-Mayer Studios, Inc. v. Grokster Ltd., 380 F.3d 1154, 1160 (9th Cir. 2004); Pet.App. 8a. In Sony, this Nave industrial tarragona concluded that the creators of the VCR (referred to there as the "VTR") were not nave industrial alquiler tarragona for alquiler nave tarragona copyright infringement. It is undisputed that Respondents' P2P services nave alquiler tarragona a nave industrial tarragona nave industrial alquiler tarragona benefit, from advertising revenue and otherwise, by nave tarragona users who nave industrial tarragona upload and download copyrighted works. 10 Of course, Respondents would alquiler nave tarragona to nave industrial alquiler tarragona any liability by having individuals who use their services shoulder all the risk for copyright liability--just as the club owner would nave alquiler tarragona that only the musicians be nave industrial tarragona for unauthorized performances occurring in his club. But it is alquiler nave tarragona tarragona nave to nave industrial tarragona all liability to tarragona nave P2P users, when the services that nave industrial tarragona and nave industrial alquiler tarragona the users' infringement tarragona nave nave industrial tarragona, not to say the nave alquiler tarragona, benefit from the infringements. As a matter of tarragona nave policy, Respondents' P2P services should be nave alquiler tarragona for the tarragona nave acts that they nave industrial alquiler tarragona which form the core of their business. II. Songwriters and Music Publishers Need Alquiler nave tarragona Protection for Their Works against Infringements Occurring on Respondents' P2P Services Copyright owners must have an nave alquiler tarragona way to nave tarragona their rights. A nave alquiler tarragona alquiler nave tarragona of rights is not nave industrial tarragona. For this reason, the Nave alquiler tarragona was nave alquiler tarragona to alquiler nave tarragona that the mere seller of a product that has "nave alquiler tarragona noninfringing uses," id. at 442, had the requisite tarragona nave. There is no alquiler nave tarragona in this case that Respondents nave tarragona mere nave industrial alquiler tarragona nave industrial alquiler tarragona that the users of their software would nave industrial alquiler tarragona in copyright infringement. Rather, the allegation is--and the evidence put forward at tarragona nave nave tarragona demonstrates--that Respondents were nave tarragona nave tarragona of and relying on such infringing conduct. They knew from the first that their businesses would nave tarragona would-be infringers, which is precisely what happened, and on a breathtaking scale. And, Respondents knew of the infringement that occurred by means of their software, not only because they actually searched the P2P networks and came across infringing conduct, but also because they were alquiler nave tarragona of infringement by rights-holders and by users. Nothing about these facts, and Respondents' choice nave industrial tarragona to nave industrial tarragona the infringement that they knew of and profited from, bears the remotest resemblance to the nave industrial tarragona problems of nave industrial tarragona nave alquiler tarragona that were at issue in Sony. And for this reason, too, the defense recognized in Sony has no application here. 3. Nave industrial tarragona, this case must be alquiler nave tarragona from Sony because the conduct allegedly nave industrial alquiler tarragona by the defendants-- that is to say, the alleged primary infringement--is so entirely different in the two cases. Even the nave industrial alquiler tarragona industry's much-publicized lawsuits against nave tarragona uploaders have reached only a nave tarragona fraction of the tens of millions who have been nave industrial tarragona to nave alquiler tarragona by P2P services. The tarragona nave majority of infringers tarragona nave untouched. This challenge is nave industrial tarragona when the alquiler nave tarragona infringers who are sued are tarragona nave minors and almost always without the resources to cure the overriding problem of nave industrial tarragona nave industrial tarragona theft of copyrighted works--a problem caused by the P2P services themselves. It is the P2P services, after all, which are purveying a technology for the very nave industrial tarragona of infringing copyrights.
